Terms of Service

1. Acceptance of Terms

By accessing or using the iClickPro platform at iclickpro.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including organization administrators, team members, and viewers.

2. Service Description

iClickPro is a SaaS photo documentation platform designed for construction and field crews. The Service provides tools for project management, photo upload and organization, AI-powered photo classification, annotation, tagging, PDF report generation, team collaboration, and client sharing. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts & Responsibilities

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials. Do not share your password with others.
  • You must notify us immediately of any unauthorized access to your account.
  • Organization administrators are responsible for managing user access, roles, and permissions within their organization.
  • You must be at least 18 years of age to create an account.
  • You are responsible for all activity that occurs under your account.

4. Content Ownership

You retain full ownership of all content you upload to iClickPro, including photos, project data, annotations, labels, and reports.

  • Your content is yours. We do not claim any intellectual property rights over your photos or project data.
  • By uploading content, you grant iClickPro a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.
  • This license terminates when you delete your content or close your account.
  • We may process your photos using AI services to provide features such as automatic classification and tag suggestions. This processing is performed only to deliver functionality within your account.

5. Acceptable Use

You agree not to use the Service to:

  • Upload, store, or transmit any content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable.
  • Violate any applicable local, state, national, or international law or regulation.
  • Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service infrastructure.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use the Service for any purpose other than its intended use as a photo documentation tool.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, sublicense, or provide the Service to third parties without our written consent.

We reserve the right to suspend or terminate accounts that violate these acceptable use policies.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • iClickPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
  • We do not guarantee uninterrupted or error-free operation of the Service. Scheduled maintenance and unforeseen outages may occur.
  • We are not responsible for any loss of data resulting from your failure to maintain backups of your content.

7. Termination

  • You may terminate your account at any time by contacting us at support@iclickpro.ai.
  • We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the violation.
  • Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days after termination to allow you to export your content, after which it will be permanently deleted.
  • Provisions that by their nature should survive termination (including ownership, limitation of liability, and dispute resolution) shall survive.

8. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and contact us to close your account.
